Ex-cop urges fresh probe over alleged assault by border chief
SHAH ALAM: Any move to end or shorten Datuk Seri Mohd Shuhaily Mohd Zain’s tenure as Malaysian Border Control and Protection Agency director-general requires legal scrutiny and royal consent, Inspector-General of Police Tan Sri Mohd Khalid Ismail said. He said the matter had been referred to the Attorney-General’s Chambers (AGC) for legal advice and the Police Force Commission for further action, as Mohd Shuhaily’s two year assignment was a formal secondment from the police approved by the King. “We are referring this matter to the AGC because Datuk Seri Mohd Shuhaily’s assignment is for a period of two years. “It is like a contract, and this contract was granted the consent of the King. “If anything arises involving suspension from duty and similar matters, the action to be taken will depend on the AGC’s advice. “However, any decision involving termination of the contract and related matters must be submitted to the King for consent,” he told reporters here yesterday. Mohd Khalid was speaking after the National Conference on Bureaucratic Red Tape Reform 2026, organised by the Malaysia Productivity Corporation. He said the legal review was necessary to ensure any action complied with the terms of Mohd Shuhaily’s secondment and the requirement for royal consent. Once the legal review and process to obtain royal consent are completed, the matter will be returned to police for further action, he said. Mohd Khalid added that Mohd Shuhaily remained a serving police officer despite his post at the border control agency. “Once he returns, I may provide a more detailed explanation of the matters that need to be addressed and the follow-up action to be taken, God willing,” he said. Meanwhile, the Home Ministry said Mohd Shuhaily’s service matter was still being finalised in accordance with existing regulations and procedures. In a statement, the ministry said it had taken note of public views on the border chief’s service and would prioritise operational continuity while the matter was being resolved. It said the border control agency, which is approaching its second anniversary, played an important role in strengthening the country’s border control and protection. The ministry said its priorities included strengthening border security, ensuring smooth operations, protecting national revenue and upholding integrity and discipline. “The priority is to ensure it continues to perform its role optimally in safeguarding the country’s security and sovereignty.” He added that it would also ensure the agency remained capable of carrying out its responsibilities effectively while the service matter was being finalised. tenure needs royal consent Ű BY KIRTINEE RAMESH newsdesk@thesundaily.com Move to end Shuhaily’s

after the alleged incident. “After seeing the principle of equality before the law upheld without discrimination through the attorney-general’s decision to prosecute Shuhaily, Saifuddin believes he still has an opportunity to obtain justice under the current administration,” they said. The lawyers urged the authorities to review the 2015 report to ensure the rule of law was upheld. On Oct 21, Mohd Shuhaily pleaded not guilty at the Sepang Magistrate’s Court to two charges of voluntarily causing hurt to two policemen at Counter J, Terminal 1 of KLIA, on Sept 28. Both charges were framed under Section 323 of the Penal Code, which carries a maximum jail term of one year, a fine of up to RM2,000, or both.
Saifuddin was manning a guard post at the Hilir Perak district police headquarters. Saifuddin claimed Mohd Shuhaily reprimanded him for failing to salute before repeatedly scolding him in front of other officers. He alleged that Mohd Shuhaily punched his left wrist and threatened to transfer him to Sabah or Sarawak as well as take disciplinary action against him. The lawyers said they had formally asked the attorney-general to review the complaint following Mohd Shuhaily’s recent prosecution over a separate alleged assault involving two policemen at the KL International Airport. They said the prosecution had renewed Saifuddin’s hope of obtaining justice more than a decade

Chegubard gets four months for defaming King
KUALA LUMPUR: Former Port Dickson Bersatu division chief Badrul Hisham Shaharin, better known as Chegubard, was sentenced to four months’ jail yesterday for making a defamatory statement that could harm the reputation of His Majesty Sultan Ibrahim, the King of Malaysia. Sessions Court Judge Norma Ismail imposed the sentence after ruling that the defence had failed to raise reasonable doubt at the end of the defence case. The court initially ordered Badrul Hisham, 48, to begin serving his sentence immediately. However, it granted his application for a stay of execution pending an appeal to the High Court and increased his bail by RM5,000 to RM15,000. Deputy public prosecutor Nursyuhada Husna Sulaiman prosecuted, while lawyer Muhammad Rafique Rashid Ali represented Badrul Hisham. On June 24 this year, High Court Judge Noor Ruwena Md Nurdin ordered Badrul Hisham to enter his defence after allowing the prosecution’s appeal against an earlier decision by the Sessions Court to acquit and discharge him at the close of the prosecution’s case. On Nov 4 last year, Norma had acquitted and discharged him, ruling that the prosecution had failed to establish a prima facie case. Badrul Hisham was charged on April 29, 2024 with making a defamatory statement, knowing that it could harm the reputation of the Yang di-Pertuan Agong. The offence was allegedly committed at the Office of the Comptroller of the Royal Household at Istana Negara at 6pm on Jan 22, 2024. The charge was framed under Section 500 of the Penal Code, which carries a maximum penalty of two years’ imprisonment, a fine or both upon conviction – Bernama
